SWEEPSTAKES OPEN TO LEGAL RESIDENTS OF THE 50 UNITED STATES OR DISTRICT OF COLUMBIA WHO ARE AT LEAST 18 YEARS OF AGE OR OLDER ON THE DATE OF ENTRY. VOID WHERE PROHIBITED BY LAW.

ELIGIBILITY: The Hyundai Bose Sweepstakes (the “Sweepstakes”) is open to all legal residents of the fifty (50) United States or District of Columbia who are at least 18 years of age or older at the time of entry (the “Entrant”). Sweepstakes is void where restricted or prohibited by law. Employees of Hyundai Motor America (the “Sponsor”), its affiliates, subsidiaries, authorized dealers, licensees, suppliers, Innocean Worldwide Americas, LLC (“Innocean”), marketing partners, advertising and promotion agencies, Marden-Kane, Inc. (the “Administrator”), Bose Corporation (“Prize Provider”), and the immediate families (spouse, parents, children, siblings and their respective spouses) and individuals living in the same household, whether related not, of the above, are not eligible to enter or win a prize. Sweepstakes is subject to all applicable federal, state and local laws.

PROMOTION PERIOD: The Sweepstakes begins on November 17, 2020 at 12:00:00 AM Eastern Time (“ET”) and ends on December 31, 2020 at 11:59:59 PM ET (the “Promotion Period”). The Promotion Period is further divided into six (6) Entry Periods (the “Entry Period(s)”) as noted in the chart (“Chart”) below. The Administrator runs the official clock for the Sweepstakes and will solely determine the time by which an entry is received.

HOW TO ENTER: Entrants can enter the Sweepstakes at www.HyundaiBoseSweeps.com by following the on-screen instructions (including providing all required information which will include their full name and e-mail address) and accepting the Official Rules of the Sweepstakes. Upon completion of the registration/entry process, Entrant will earn one (1) entry (an “Entry”) into the corresponding Entry Period, as outlined in the Chart above. Limit of one (1) entry per person throughout the Promotion Period. Entries received in one respective First Prize Entry Period will also be included in subsequent First Prize Entry Periods (#1 through #5). All eligible Entries will be included in the Grand Prize Entry Period drawing (#6). Any individual who attempts to/or is suspected of submitting more than one (1) entry for the entire Promotion Period will be disqualified from participation in the Sweepstakes.

Entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. Entries are subject to the acceptance and acknowledgement of these Official Rules and any other applicable Terms of Services/Privacy Policy. The “authorized account holder” is defined as the natural person who is assigned to an e-mail address by an internet access provider, on-line service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. If you choose to enter via wireless device, you may be charged data rates according to the Terms and Conditions of your Service Agreement with your wireless carrier. Each wireless carrier's rate plan may vary, and entrants should contact their wireless carrier for information on rate plans and charges relating to your participation in this Sweepstakes.

Sponsor is not responsible for lost, late, damaged, delayed, destroyed, misdirected, incomplete, illegible, mutilated, technically corrupted or garbled Entries, which will be disqualified, or for problems of any kind whether mechanical, human or electronic. No automated entry devices and/or programs permitted. Incomplete or illegible Entries are not eligible. All Entries become the property of the Sponsor and will not be returned. Proof of submission will not be deemed to be proof of receipt by Sponsor.

PRIZES: There will be eighty (80) First Prizes awarded in each First Prize Entry Period (#1 through #5, as detailed above) for a total of four hundred (400) First Prizes of a Bose Audio Frames Alto (medium/large size only). ARV of the First Prize is $200 each. Total ARV of all First Prizes is $80,000. Ten (10) Grand Prizes (awarded in the Grand Prize Entry Period #6): Bose Noise Cancelling Headphones 700. Approximate Retail Value (“ARV”) of the Grand Prize is $400 each. Total ARV of all Grand Prizes is $4,000. Total ARV of all prizes offered in the Sweepstakes is $84,000. Total number of prizes awarded for the entire Sweepstakes will not exceed four hundred and ten (410). All prizes will be awarded provided a sufficient number of qualified eligible Entries are received per Entry Period.

PRIZE RESTRICTIONS: No substitutions, cash equivalents, or transfer of prize permitted except at the sole discretion of the Sponsor, who reserves the right where lawful to substitute a prize with one of comparable or greater value. Prize may not be sold, bartered, or exchanged by winner. Prize consists of only those items specifically listed as part of the prize. Sponsor is not responsible for damage or loss of a prize after it has been delivered to a confirmed winner. Sponsor makes no warranties, and hereby disclaims any and all warranties, expressed or implied, concerning any prize furnished by third parties in connection with the Sweepstakes. All details of prizes not specified herein shall be determined solely by Sponsor. All federal, state, and other tax liabilities arising from a prize are the sole responsibility of the prize winner.

RANDOM DRAWINGS: There will be a total of six (6) random drawings conducted from all eligible Entries received to award prizes as outlined in the Chart above. All drawings will be conducted by the Administrator, whose decisions on all matters pertaining to the Sweepstakes are final. Odds of winning a prize depend on the total number of eligible Entries received for each Entry Period. Potential winners are subject to eligibility verification and compliance with these Official Rules. Limit of one (1) First Prize and one (1) Grand Prize per household throughout the Sweepstakes.

WINNER NOTIFICATION AND CLEARANCE: Potential Prize winners will be notified by the Administrator via email on/about the notification date noted on the Chart above, and will be required to complete, sign, and return an Affidavit of Eligibility and Liability Release and; where legal, a Publicity Release (collectively the “Affidavit”). The Affidavit must be returned to the Administrator by the date stated in the notification email or the prize will be forfeited and awarded to an alternate potential winner. If a potential winner (i) cannot be contacted after a reasonable attempt has been made by Administrator (as determined in Sponsor’s sole discretion); or (ii) fails to timely return the required paperwork without alteration and in the form presented by Administrator; or (iii) refuses the prize; or (iv) the prize or prize notification is rejected or returned as undeliverable, then such potential winner will be disqualified and forfeits all rights to be deemed a winner in the Sweepstakes and receive the prize, and an alternate winner will be selected through a random drawing by the Administrator from the remaining eligible Entries. Upon prize forfeiture, no compensation will be given. Except where prohibited by law, the winner’s entry and acceptance of the prize constitutes permission for the Sponsor to use said winner’s name, address (city and state), photograph, likeness, statements, voice, statements, and biographical information without further compensation for advertising and promotional purposes without notice. All Prizes will be fulfilled approximately 6 to 8 weeks following eligibility verification.

CONDITIONS OF ENTRY: By participating, Entrants agree to comply with these Official Rules including all eligibility requirements. Sponsor reserves the right to disqualify Entrants who violate these Official Rules or interferes with this Sweepstakes in any manner. Any attempt by any Entrant to obtain more than one (1) entry by using multiple/different email addresses, identities, registrations and logins, or any other method will void that Entrant’s Entries and that Entrant may be disqualified. Use of any automated entry software is prohibited. Electronically reproduced, illegible, incomplete or inaccurate Entries are void. In case of a dispute as to the owner of an online entry, online entry will be deemed to have been submitted by the authorized account holder of the account from which the entry is made. Sponsor, Administrator, Prize Provider, Innocean, and their respective affiliates, subsidiaries, divisions, advertising and Sweepstakes agencies, and all of their officers, directors, shareholders, employees, and agents (collectively “Released Parties”) are not responsible for incorrect or inaccurate transcription of entry information, or for any human or printing error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any online service or website, inability to submit the online registration form, or any other error or malfunction, or any injury or damage to Entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Sweepstakes, or for late, lost, stolen, illegible, misdirected or damaged mailed Entries. Entry materials that have been tampered with or altered are void. If, in the Administrators’ opinion there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of this Sweepstakes, or if technical difficulties compromise the integrity of the Sweepstakes, the Administrator reserves the right to void any Entries at issue and/or to suspend, modify, cancel or terminate this Sweepstakes, in whole or in part, at any time without notice and award the prizes in a random drawing from among all non-suspect eligible Entries received as of the termination date. Caution, any attempt by an Entrant or any other individual to deliberately damage any online service or website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages and/or other remedies from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision.

GENERAL CONDITIONS: By entering the Sweepstakes, you grant the Released Parties permission to use your personal information in accordance with Sponsor’s privacy policy, located at www.hyundaiusa.com/privacy-policy.aspx. By accepting a prize, winner consents to the use of his/her name, city/state of residence, photograph, visual and/or audio likeness for advertising or Sweepstakes purposes by Sponsor, and its designees, including but not limited to the posting of winner’s name on the Sponsor’s website(s), in a Winners List or other online announcements, without additional compensation, permission or notification except where prohibited by law. Entrants agree to release indemnify and hold harmless the Released Parties from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, participation in, Sweepstakes, or possession, acceptance and/or use or misuse of prize or participation in any Sweepstakes-related activity and for any claims based on publicity rights, defamation or invasion of privacy and merchandise delivery. Persons who tamper with or abuse any aspect of the Sweepstakes or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated Entries will be void. Should any portion of the Sweepstakes be, in Sponsor’s sole opinion, compromised by any means, which, in the sole opinion of the Sponsor, impairs the administration, security, fairness or proper play, or submission of Entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes and, if terminated, at its discretion, select the potential winner(s) from all eligible, non-suspect Entries received prior to action taken using the judging procedure outlined above.

LIMITATION OF LIABILITY; DISCLAIMER OF WARRANTIES: TO THE MAXIMIM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE SITE AND/OR PARTICIPATING IN THE SWEEPSTAKES, DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY WEBSITES ASSOCIATED WITH THE SWEEPSTAKES. WITHOUT LIMITING THE FOREGOING AND TO THE MAXIMIM EXTENT PERMITTED BY LAW, THIS SWEEPSTAKES AND ALL PRIZES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.

DISPUTES; Governing Law; FORUM: The parties waive all rights to trial in any action or proceeding instituted in connection with these Official Rules, including, without limitation, the Sweepstakes. Any controversy or claim arising out of or relating to these Official Rules and/or the Sweepstakes shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in Orange County, in the State of California. The Sweepstakes is governed by the laws of the United States. All federal, state and local laws and regulations apply. The construction, validity and interpretation of the Sweepstakes shall be governed by the laws of the State of California, without giving effect to any choice of law or conflict of law rules. For any matters which are not subject to arbitration as set forth in these Official Rules and/or in connection with the entering of any judgment on an arbitration award in connection with these Official Rules and/or the Sweepstakes, the parties irrevocably submit and consent to the exclusive jurisdiction and venue of the state and federal courts located in or closest to the Orange County in the State of California. The parties agree not to raise the defense of forum non conveniens.

Severability: If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
